Ellen Hirshman, a principal with the Cleveland personal injury and medical malpractice law firm of Linton & Hirshman LLC, will be installed as Treasurer of the Cleveland Academy of Trial Attorneys on June 24, 2011 at the Club at Key Tower. Guest speaker will be nationally renowned trial lawyer Gerry Spence. Author of “Gunning for Justice,” Spence represented Karen Silkwood in a landmark case that later became a Hollywood movie starring Meryl Streep and Cher.

The Cleveland Academy of Trial Attorneys is the largest professional organization of personal injury and wrongful death trial attorneys in Ohio. It provides continuing legal education, support and resources to its members to help obtain justice for their clients. “It helps level the playing field when up against the resources of the billion dollar insurance industry,” says Ellen Hirshman, “especially when they fail to pay legitimate claims.” The Cleveland Academy also gives back to the community. It is a strong supporter of Youth Challenge - a local charity providing sports and recreational activities to physically disabled children in Northeast Ohio.

Once installed as Treasurer, Ellen will be on track to become the firm’s third President of the 52 year old Academy. Robert F. Linton, Jr. served as President in 1999-2000 and Steve Keefe in 2008-2009. Linton and Hirshman is one of Ohio’s leading personal injury and wrongful death law firms with some of the largest reported verdicts and settlements in the state.

The firm’s leadership roles extend throughout Ohio. Toby Hirshman, another partner in the firm, served as head of the medical malpractice section for the state trial lawyers group known as the Ohio Association for Justice. “More than a million people have died from preventable medical errors over the last decade alone,” says Ellen, citing to a recent study from Consumer’s Union. She says, “The numbers are staggering…but stoppable if we can prevent those responsible from violating simple patient safety rules.”

A well respected trial lawyer for nearly 30 years, Ellen heads up the Woman’s Health Law Center at Linton & Hirshman. She has expertise and sensitivity in the unique medical issues facing women. These include failure to diagnose breast and cervical cancer and birth injuries to newborns. Ellen was also previously appointed by the Ohio Supreme Court to the Board of Commissioners on Grievance & Discipline - the board charged with investigating and hearing formal disciplinary charges against lawyers and judges. “Our goal was to prevent harm to Ohio citizens and its system of justice,” she reports. According to the Ohio Supreme Court website, the Board serves as a facilitator and resource for upholding the highest principles of the legal profession. Ellen Hirshman says her newly elected office will give her a platform to continue to uphold those same principles.

Family files lawsuit over daughter's brain injury | New Orleans ...

A family recently filed a lawsuit against their daughter's boyfriend and his family claiming that they are responsible for the injuries their 42-year-old daughter sustained after supposedly slipping on an icy driveway.

According to the civil complaint, the 42-year-old was leaving her boyfriend's home around 2 a.m. when she slipped and fell outside. From the slip and fall she was knocked unconscious, and when her boyfriend went to pick her up off the ground, he allegedly dropped her or somehow caused her head to violently hit the ground several more times.

Next the boyfriend reportedly called his parents, who came to his house and carried the still unconscious 42-year-old to their car and drove her to the hospital without first even calling 911.

Once at the hospital it was learned that the woman had multiple contusions and fractures to her head, which doctors said is inconsistent with the injuries a person would receive from an accidental fall.

According to the lawsuit, once at the hospital her boyfriend and his parents also refused to tell medical personnel or police what had actually happened to cause such serious injuries, which delayed and complicated her needed treatment, and also added to the severity of her head injuries .

According to a police lieutenant assigned to the case, when her boyfriend was asked to describe what had happened to cause her injuries, instead of answering any questions he hired a lawyer.

At this point, the father of the 42-year-old said that he just wants to know what happened that night, and claims that if it really was just an accidental fall then her boyfriend and his family would have nothing to hide.

An attorney representing her boyfriend and his family said that he was actually hired because the family of the 42-year-old was harassing his clients and blaming them even before police launched an investigation.

At one point doctors didn't even think the woman was going to make it, but after being in a coma for two months she did wake up, and is now slowly able to walk, talk and recognizes some people. However, she has no recollection of what happened the night of the accident.
