Texas-based paralegal illegally offering law services

PROVIDENCE - The state Supreme Court determined that the Texas-based paralegal service that Internet advertising to boost sales is engaged in the unauthorized practice of law in Rhode Island.

David Curtin, Chief Disciplinary Counsel Court said Low Cost Paralegal Services, whose last known address was in San Antonio, Texas, and its owner, Dominique M. Salazar, also known as Michelle Salazar, made advertising low-cost legal services on Craigslist and other websites.

Curtin said Salazar is not a lawyer and even if she had an e-mail attorney2be2012, "I do not think she ever was in law school."

Curtin said Salazar tried to solicit business in Rhode Island, offering "a complete divorce for $ 400 flat" and other legal services in the areas of adoption, custody issues to children, name changes, living wills, wills, powers of attorney and deeds.

"We do not know if anyone in Rhode Island has used his services, but they were certainly offer their services in Rhode Island," Curtin said Tuesday. He said this was an example of a “nonlawyer document-preparation service” trying to mask itself as a legitimate provider of low-cost legal services.

Curtin referred the matter in April 2010 to the court’s Unauthorized Practice of Law Committee, which conducted an investigational hearing late last year.

The committee, chaired by Newport lawyer Richard P. D’Addario, determined that Low Cost Paralegal Services and Salazar had falsely held themselves out to Rhode Islanders in Internet advertising “as competent and qualified to prepare legal documents for uncontested divorce, and to assist with a child-support problem, which conduct constitutes ‘the practice of law.’ ”

Salazar told the committee she had ceased such conduct “and will not resume,” but the committee found her not to be credible. The court said Salazar did not contest D’Addario’s committee’s findings.

“Further steps are required to protect Rhode Islanders,” the court said in its May 19 order.

I have been browsing Craigslist, and I came across an ad for a bunch of stuff, including a sp studios excalibur system, white lightning x800, a bunch of developing gear, Nikon hoods, etc. It seems a little shady, since when I emailed him, he said that he was actually in San Antonio, but he's posted in Austin. I got curious, and started doing some google searches, and I came across the same ad in many other cities, along with a few posts here: The Austin one has been flagged for removal. Does this sound fishy to anyone? Do you think it's a setup for some kind of scam, or is he just desperate to sell and is posting in multiple cities? If so, then he isn't doing a very good job. He isn't directly connected with the equipment, so he can't really vouch for it (he tried to tell me that the x800 is unused. Yeahhhh right). Also, he's asking pretty ridiculous prices. $325 for an old X800, when a new one is $390, or $350 with student discount and comes with 5 year warranty, and then he's insisting on selling the 85mm lens hood separately from the lens. I sent him an email, but I'm definitely wary about this. I will want him to meet at like a Starbucks or something, and I told him that he has to come down to a realistic price (there are Hensel lights in Dallas Craigslist that I could just have my brother pick up for me for the same price), and factor in time and gas, considering he's expecting people to go to San Antonio. Plus, it kind of sucks that it's obvious from his post that he doesn't know much, if anything, about the equipment, so he can't really check anything before I'd drive down there. Any thoughts?
